旅行证 vs. 中国签证:核心区别
- 中国旅行证:发给中国公民(具有中国国籍)在紧急或特定情形下作为旅行证件使用。
- 中国签证:签发给外国国籍人员,用于入境中国。
法律依据(摘录)
《中华人民共和国国籍法》第五条:父母双方或一方为中国公民,本人出生在外国,具有中国国籍;
但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。
注:“定居”通常指已取得长期居留/永久居留资格(如美国绿卡)。短期签证(商务、旅游、学习、工作等)一般不视为定居。
孩子在美国出生,回国办签证还是旅行证?
按上法条,关键在于孩子出生时中国籍父/母是否已定居国外(如持美国绿卡)。以下为常见情形的参考整理(最终以使领馆认定为准):

- 若孩子出生时父/母为临时身份,而在提交申请时已获得美国绿卡或入籍,则按已定居/外国国籍情形评估(通常按签证准备)。
- 若提交时仍为非移民/未定居身份,可按旅行证情形评估。
- 最终是否具有中国国籍及应办证件,以受理馆核实及裁量为准。
其他情况与历史记录
- 儿童曾持有中国旅行证且可提供记录:通常可继续申请旅行证。
- 儿童曾持有中国签证且可提供记录:通常可继续申请签证。
- 曾办过但无法提供旅行证/签证记录:按首次回国所需材料准备。
- 若申请人决定放弃中国国籍改办签证,通常需先按所在地政策办理退籍相关手续,取得退籍证明后再办签证。详见官方说明:放弃中国国籍信息。

Travel Document vs. China Visa
- Travel Document: for PRC nationals under certain circumstances, serving as a travel credential.
- China Visa: for non-PRC nationals to enter China.
Legal basis (excerpt)
Nationality Law of the PRC, Article 5: A person born abroad whose parents are both Chinese nationals or one of whose parents is a Chinese national shall have Chinese nationality;
however, if either or both parents are Chinese nationals and have settled abroad, and the person acquires a foreign nationality at birth, he/she shall not have Chinese nationality.
“Settled abroad” generally refers to long-term/permanent residence (e.g., U.S. green card). Short-term visas (B, F/M/J/H/L, etc.) are usually not regarded as settlement.
US-born child: Visa or Travel Document?
The key factor is whether the Chinese parent(s) had settled abroad at the time of birth. Typical scenarios below (final decision rests with the consulate):

- If at submission time a parent has obtained US PR or citizenship (though he/she held temporary status at birth), assess as settled/foreign nationality (typically, apply for a visa).
- If still non-immigrant / not settled at submission, a Travel Document route may apply.
- Consular officers make the final determination on nationality and document type.
