Moving to China for Work: Can Your Unmarried Partner Get an S1 Visa?

An employer’s relocation package is not dependent-visa eligibility. Check the S1 relationship rule and plan a separate lawful route for an unmarried partner.

Direct answer: Not simply because you live together or your employer includes your partner in a relocation package. The published S1 family route lists spouses and certain other close relatives, not an unmarried partner as such. The separate “other private affairs” wording requires case-specific supporting evidence; it is not a general girlfriend, boyfriend or fiancé entitlement.

Check each person’s immigration basis separately

For a U.S. employee taking a job in China, the employer should establish the employee’s work-authorization route. That does not automatically establish the partner’s entry or residence route. Prepare two separate document checklists and timelines before agreeing on a joint moving date.

Ask HR exactly what “dependent support” covers: immigration eligibility review, application assistance, travel expenses or housing. A company can offer a benefit without being able to obtain a particular immigration status. Request the name of the authority or written requirement behind any claim that cohabitation is sufficient.

Do not turn a relationship history into a marriage certificate

The Embassy’s S1 family checklist requires relationship certification and the foreign inviter’s passport and residence permit. Photos together, a shared lease or an engagement announcement do not by themselves establish a spouse relationship under that published checklist. Describe the relationship accurately on forms and in letters.

If your circumstances may fall under another private-affairs provision, ask the responsible Chinese mission about the exact basis and evidence before selecting it. An employer’s general reassurance, a different city’s anecdote or a past applicant’s result is not enough to confirm that exception for you.

Consider a genuine independent purpose—not a workaround

If your partner intends to accept a job, the prospective employer should assess an independent work route before employment begins. If the purpose is genuine study, discuss admissions and visa documentation with the school. Neither route should be selected merely as a label to support living with you.

A short tourist visit is different from moving for the entire length of a work contract. When discussing travel plans, separate a visit from a long-term residence plan. Do not budget for repeated border trips as if each re-entry or extension were assured. A partner who wants to work also needs that activity assessed separately from permission to accompany someone.

Use a relocation decision checklist before paying deposits

Write down the partner’s actual purpose, intended length of stay, relationship status, expected work or study activities, and the proposed city. Ask which office will decide the initial visa and which will handle any residence permission after arrival. Keep unresolved items visible instead of assuming they will be solved once you land.

If the couple later marries, revisit the documentation and timing rather than assuming earlier forms remain correct. If no verified long-term route is available, consider a later move or a genuinely shorter visit. Resolve the immigration plan before signing a nonrefundable shared lease or shipping both households.

Frequently asked questions

Does switching from S1 to S2 automatically solve this?

No. S2 has a different duration and family scope, but it is not a blanket unmarried-partner category. Other private matters still require case-specific confirmation.

Can a residence permit after arrival fix an unverified entry plan?

Do not rely on that assumption. The national private-affairs residence guide also distinguishes family relationships and other supported private affairs; confirm the whole route in advance.
