Changing Employers in China: What Happens to the Work Permit?
A China work permit is tied to the authorized employer and role; changing employers requires formal cancellation, change or a new filing plus review of the work-type residence permit.
Why the employer name matters
Employment rules require the actual employer to match the authorized employer. Older national rules distinguish a same-area, same-nature change requiring approval from a different-area or different-nature move that requires new formalities. Current local systems implement change and cancellation through the employer.
If the work-permit notification contains the wrong school, company or location before the Z application, correct it through the responsible employer channel instead of assuming it will be easy to fix after entry.
Coordinate the old and new employer
Build a written handoff covering the last work date, permit cancellation or release documents, new contract, new employer filing and residence-permit deadline. Do not rely on an informal promise that the record will disappear when the contract ends.
The new employer should confirm the accepted documents and whether a direct in-China filing is available for the specific occupation and valid residence status. A Shanghai exception or community experience is not a nationwide guarantee.
Residence status is a separate deadline
Changing the work permit does not automatically update the residence permit. Current local guidance requires changes to employer-related residence information within the prescribed period; verify the exact date and documents with the issuing exit-entry authority.
Do not work during an authorization gap or assume a temporary stay document permits employment. Keep copies of cancellation, application receipts and new approvals, and avoid international travel until re-entry status is clear.
Frequently asked questions
Can I work for the new company while the old permit is valid?
Not merely because the permit remains unexpired. The authorized employer and actual employer must be aligned through the required process.
Do I need another Z visa?
Not every in-China employer change uses a new overseas Z application. The local work-permit and exit-entry authorities must confirm the path for the case.
What if the old employer will not cooperate?
Document the issue and contact the competent work-permit authority promptly; do not submit altered or false release records.
